Fuel Distribution Facilities Register

Law no. 124 of 4 August 2017, the "Annual Law for Market and Competition", in Article 1, paragraphs 98 to 119, includes provisions on rationalising the fuel distribution system aimed at enhancing market competition and providing consumers with relevant information.


Specifically, paragraph 100 provides for the establishment of a Register of petrol, diesel, LPG, and methane fuel distribution facilities on the road and motorway network, to which holders of authorisations/concessions for fuel distribution facilities are required to register by 24 August 2018 (deadline extended by Law no. 205 of 27 December 2017, Article 1, paragraph 1132).

Upon registration in the register, holders of fuel distribution facilities must simultaneously submit a self-declaration in lieu of affidavit (dichiarazione sostitutiva dell’atto di notorietà) pursuant to Article 47 of Presidential Decree No. 445/2000. This declaration, addressed to the Ministry of Economic Development (MiSE), the competent regional authority, the authority responsible for issuing the authorisation or concession, and the office of the Customs and Monopolies Agency, must certify whether, specifically concerning road safety aspects, the facility does or does not fall within one of the incompatibility cases provided for by current regional provisions as detailed in paragraphs 112 and 113, Article 1 of the Competition Law. Alternatively, if the facility does fall within these incompatibility cases, the holders must commit to achieving compliance within 18 months from the entry into force of Law No. 124/2017 (deadline amended by Law No. 205 of 27 December 2017, Article 1, paragraph 1132).

To streamline procedures related to the above-mentioned obligations and reduce administrative burdens for companies, the Unified Conference, in its session of 8 March 2018, established that registration in the Fuel Facilities Register and related obligations should be carried out exclusively through the specific MiSE online platform, created within the impresainungiorno.gov.it web portal (Fuel Facilities Register).


The Ministry of Economic Development (MiSE), Regions/Autonomous Provinces, Local Authorities, and the Customs and Monopolies Agency consider obligations established by the Competition Law fulfilled only when completed via the aforementioned electronic method. In this regard, it is specified that registration in the Fuel Facilities Register and submission of the self-declaration in lieu of affidavit constitute essential requirements for the validity of the authorisation or concession.

 

Additionally, using the "dynamic update" features, holders of authorisations/concessions can carry out updates or modifications of their data by using the facility's unique identifier.
