Simplification and reorganisation of the regulations on the One-Stop Shop for Productive Activities (pursuant to the Presidential Decree of 7 September 2010, no. 160)

The SUAP is the tool that puts businesses in contact with the public administration, the reform law defines it as follows: "the one-stop shop constitutes the only point of access for the applicant in relation to all administrative matters concerning his production activity and also provides a single and timely response in place of all the public administrations involved in the procedure".

The One-Stop Shop for Productive Activities (SUAP) is an administrative simplification tool that in turn uses other simplification tools (service conference, SCIA, tacit consent, agreement between public administration and private individuals, etc.) in order to streamline relations between Public Administration (PA) and users.

The One-Stop Shop, identified as the exclusive channel between entrepreneurs and the Administration to eliminate procedural and documentary repetitions, regulated by Presidential Decree 20 October 1998, no. 447, has not been fully implemented due to the lack of connection between the various competent Administrations, the lack of specification of a definition of the essential services that can be provided (with the consequent lack of consistency in the services provided by the individual one-stop shops), and the uncertainty as to the timing and final acts of the procedure.

This situation was addressed by Article 38, paragraph 3, of Legislative Decree no. 112 of 25 June 2008, converted with amendments by Article 1, paragraph 1, of Law no. 133 of 6 August 2008, which provides for the reorganisation and simplification of the SUAP regulations.

To this end, Law No. 133/2008 refers to a regulation (pursuant to Article 17(2) of Law No. 400 of 1988), upon the proposal of the Minister of Economic Development and of the Minister for Regulatory Simplification, in agreement with the Minister for Public Administration and Innovation, after consulting the Unified Conference, the reorganisation and simplification of the SUAPs, in compliance with the provisions of Articles 19(1) and 20(4) of Law No. 241 of 1990, in accordance with the principles and criteria listed in the aforementioned paragraph 3.

This regulation repealing the former Presidential Decree No 447 of 1998 organically redefines the regulations of SUAPs, albeit in two different moments::

  • 6 months for the so-called automated procedure
  • 1 year for the ordinary procedure.
