SUAP requirements and functions

The technical requirements and functions attributed to SUAPs by the reform. Simplification and reorganisation of the regulations on One-stop shop for Productive Activities (pursuant to Presidential Decree No 160 of 7 September 2010)


The functions attributed to the SUAP by Art. 38 of the Regulation and the minimum technical requirements.
On the basis of these functions, for the SUAP the ability to initiate, manage and conclude the aforementioned procedures electronically constitutes a fundamental technical-operational requirement, in order to operate in accordance with the provisions of the Presidential Decree (and in accordance with the CAD).

According to art. 2, paragraph 1 of Presidential Decree n. 160 of 7 September 2010 (Implementation Regulations of the provisions of art. 38 of DL. 112/2008), the SUAP of Impresa in un giorno is the sole public body of territorial reference for all procedures having as its purpose the pursuit of productive activities and the provision of services, and those relating to the location, realisation, transformation, restructuring or reconversion, expansion or transfer as well as the termination or resumption of the aforesaid activities, including those referred to in Legislative Decree n. 59 of 26 March 2010."

For any administrative matter concerning Productive Activities, the SUAP provides businesses with a single and timely response on behalf of all public administrations involved in the procedure.

For SUAPs, the ability to initiate, manage and conclude the above-mentioned procedures by computer and electronic means constitutes a fundamental requirement of a technical-operational nature in order to operate in accordance with the provisions of the Presidential Decree.

For these specific aspects, the reference document is the Technical Annex to the Regulation, which fully describes the electronic communication and data transfer modalities between the SUAP and all parties involved in the procedure.

The Annex explicitly refers to technological solutions that are optimal with respect to the objective of automating information flows and data interchange, being aware, however, that these solutions may not currently be available to all SUAPs.

As explained several times in the text of the Annex itself, pending the adoption of more appropriate and performing technological solutions, the institutional functions of the SUAP can in any case be performed through the possession of the following minimum technical requirements:

  • institutional PEC mailbox, to which the SUAP refers, to receive documentation from businesses; sending receipts and acts relating to proceedings; forwarding acts, communications and related attachments to the other administrations in any way involved in the proceedings and receiving from them communications and acts in electronic format;
  • digital signature issued to the person in charge of the SUAP, for signing acts in electronic format;
  • software application for reading digitally signed documents. Signature verification and subsequent extraction of signed documents can be performed with any software capable of processing signed files in compliance with CNIPA Resolution No. 45 of 21 May 2009, the list of which is available on the DIGITPA website. These applications are available free of charge on the web;
  • computerised recording of incoming and outgoing documentation, for the certification of correspondence, as provided for by Presidential Decree 445 of 28 December 2000 and the Prime Ministerial Decree of 31 October 2000;
  • SUAP website or its reserved area within the institutional site, where information on administrative procedures is published in addition to the reference forms and where users can check the status of their applications. This web area can also be located within web portals set up by an association to which they belong, the Province or the Region.

Municipalities that have already started a One-Stop Shop capable of operating at least in compliance with the minimum technical requirements must send a certificate of conformity to the Ministry for Economic Development, using the electronic procedure available at www.impresainungiorno.gov.it.

The certificate is valid for the SUAP's registration in the national list published on the web Portal.
