The changes introduced by Presidential Decree 160/2010

The SUAPs regulation simplifies and computerises administrative procedures. Computerisation is made compulsory, and is achieved through minimal restructuring or, in any case, by making use of and integrating existing infrastructures and networks (as part of the Chambers of Commerce IT system). The web portal impresainungiorno.gov serves as an electronic point of connection and interaction between all the subjects and authorities involved, including the Agencies for Enterprises

On 30 September 2010 was published in the OJ No. 229 the presidential Decree No. 160 of 7 September 2010 adopting the Regulation for the simplification and reorganisation of the regulations on the One-Stop Shop for Productive Activities, which:

  • identifies (art. 2 paragraph 1) in the One-Stop Shop the only public body of territorial reference for all procedures having as their purpose the pursuit of productive Activities and the provision of services, and those relating to the location, realisation, transformation, restructuring or reconversion, expansion or transfer, as well as the cessation or reactivation of the aforesaid activities, including those referred to in Legislative Decree No. 59 of 26 March 2010, specifying (art. 2, paragraph 2) that the applications, declarations, notifications and communications, as well as the technical documents and annexes referred to in paragraph 1, shall be submitted exclusively electronically.
  • confirms the competence of the One-Stop Shop with regard to the electronic forwarding of the documentation to the other Administrations involved in the procedure (art. 2 paragraph 3).
  • identifies the Impresainungiorno web portal as the linking function with the infrastructures and networks already in operation (art. 3) for the exchange of information and electronic interaction between the Public Administrations and the other entities involved. The web portal is therefore entrusted with the connection and redirection to information systems and web portals that have already been set up, ensuring interoperability between administrations (art. 3 paragraph 2).
  • It introduces Agencies for Enterprises into the system, a private-sector entity authorised to carry out investigative and certification functions.

The Regulation thus opens the way to a comprehensive scope of competence for the SUAP. This assumption must necessarily guide the organisational choices of municipalities, Chambers of Commerce and Third-party Authorities.
