Register of Producers of Batteries and Accumulators

Article 14 of Legislative Decree 188 of 20 November 2008 provides for the establishment, at the Ministry of the Environment and Protection of Land and Sea, of the National Register of Entities required to finance waste battery and accumulator management systems. Within this register, there is a specific section dedicated to collective schemes established for financing the management of waste batteries and accumulators

A producer of batteries and accumulators may only place such products on the market following electronic registration with the Register, to be completed at the competent Chamber of Commerce. This registration must be carried out, in accordance with the provisions of Annex III, within six months from the date of entry into force of this Decree.

Pursuant to Article 3(1)(m), the term producer refers to, and therefore requires registration by, any person who places batteries or accumulators onto the national market for the first time on a professional basis, including those incorporated into devices or vehicles, regardless of the sales method used, including distance-selling methods defined in Articles 50 and subsequent articles of Legislative Decree No. 206 of 6 September 2005, implementing Directive 97/7/EC on the protection of consumers in respect of distance contracts.
