As provided for by the Presidential Decree 160/2010, Article 5, paragraph 2, the SCIA may be submitted to the SUAP through the territorially competent Chamber of Commerce, by attaching it to a Single Communication application.

After submitting the Single Communication application, which includes an attached SCIA, the Chamber of Commerce immediately forwards the notification to the competent SUAP and issues the business a receipt detailing the actions performed. Pursuant to Article 5 of the Ministerial Decree dated 10/11/2011, this receipt is valid for the business undertaking for the purpose of commencing business operations and serves as effective date for the "automated" procedure.

If the competent SUAP is managed by an accredited municipality, the SCIA (with its relevant annexes) is sent to the PEC address registered in the National List of SUAPs.

If, however, the SUAP concerned is part of the Chambers of Commerce, the SCIA is automatically filed in the virtual “desk” of the competent Municipality. The Process Owner will find the new SCIA among those marked as 'received', ready to be processed alongside others submitted directly via the front office.

Operational guidance for businesses

If a business undertaking intends to submit a SCIA simultaneously with a Single Communication application (pursuant to Presidential Decree No. 160/2010 art.5 c.2) addressed to a municipality that uses the SUAPs OSS of the Chambers of Commerce, the Report must be compiled exclusively through the front office tools of the 'impresainungiorno.gov.it' web portal. The Front Office service of the Chambers of Commerce enabled to send SCIAs at the same time as the Single Communication is called ComunicaStarweb. In this case, it is sufficient to fill in the appropriate section entitled 'Submitting a SCIA'. Submitting SCIAs at the same time as the Single Communication via the ComunicaFedra service is not possible.

 

In cases where a SCIA is submitted at the same time as the Single Communication, the Chamber of Commerce shall serve only as the electronic recipient (by giving an “acceptance receipt”) of the submission. From an administrative standpoint, SUAP continues to be the responsible authority. Therefore, businesses shall continue to contact the SUAP for all requests for information and assistance regarding the requirements to be certified for conducting their activity, the content of the application, the steps to be followed, and any documents or instruments received or requested by the SUAP or other competent authorities.
