Following recent legislative changes, AGCOM, by Resolution No. 397/13/CONS, has updated the regulation governing the Economic System Information (hereinafter also referred to as IES). 

Consequently, the initial deadline for submitting the Economic System Information (IES) notice was rescheduled to 15 July this year, leading to an extension of the final deadline to 15 October 2013.

The entities required to comply are network operators, providers of audiovisual or radio media services, providers of associated interactive services and/or conditional access services, broadcasting businesses, advertising concessionaires (including those engaged in online and cinema advertising), national news agencies (including entities whose news bulletins are distributed via paid subscription, irrespective of the means of transmission used, to at least one national publisher producing content pursuant to Law No. 62 of 2001), and publishers—including electronic format publishers—of daily newspapers, periodicals or magazines, other periodic publications, yearbooks, and other editorial products.

Thus, as of this year, all entities that directly or indirectly collect online advertising are required to report annually to the IES.

Entities otherwise subject to the obligation to submit the Economic System Information but whose total revenues—including public funding and contracts with public entities—attributable to activities covered by the Economic System Information are equal to zero euros for the reporting year, remain exempt the Economic System Information requirement.

Each report must be submitted according to the form available on the Authority’s website (www.agcom.it), under the section "Economic System Information", and sent to the following email address: ies@cert.agcom.it.

The form is provided as an interactive PDF file, to be filled in electronically following the instructions in the user guide and those specific to each activity sector (broadcasting, publishing, internet, and advertising concessionaires).

Please note that only forms submitted in their original interactive PDF format will be considered valid. Scanned copies or other formats will not be accepted, as the automatic acquisition system for retrieving forms from the certified email address is unable to process alternative formats and/or attachments.

Therefore, please include any necessary clarifications and specifications in the notes section without attaching additional files, as such attachments cannot be processed. It is also recommended to send only one form per email.

The system information note is an annual declaration required from entities operating in communication sectors regulated by the Authority (network operators, providers of audiovisual or radio media services, providers of associated interactive and/or conditional access services, broadcasting businesses, advertising concessionaires, national news agencies, publishers—including electronic formats—of daily newspapers, periodicals or magazines, other periodic publications, yearbooks, and other editorial products). This declaration contains identification details and financial data related to the business activities conducted by such entities.

Compliance involves completing an electronic form and sending it from a certified email address (PEC) to the following address: ies@cert.agcom.it. For 2013, communications must be sent from 15 July until 15 October.
