Legal Notice and Policy for the Processing of Personal Data

This information, provided pursuant to EU Regulation 2016/679 on the protection of personal data (hereinafter “Privacy Regulation”), describes the methods and purposes of the processing of the personal data of Users accessing the Services made available through the Portal www.impresainungiorno.gov.it. (hereafter “the Portal”) with regard to:

Services of an informative nature, or services that allow the entrepreneur or his delegate to receive information assistance;

Digital identity authentication services;

Services of a dispositive nature enabling the contractor or the delegate to manage the administrative performance, in particular: — Service displayed on the home page under the heading “Manage online the practices for your business”; – Services of the “Company and Central PA” section.

Data Controller

The Data Controller is Unioncamere, headquartered in Piazza Sallustio, 21-00187 Roma.

Purposes and methods of processing

All personal data provided through the services provided by the Portal will be processed in compliance with the principles of lawfulness and correctness established by the Privacy Regulation, in order to provide users with the services requested as well as to respond to any requests or communications of users, always in pursuit of the purposes of institutional type of the Owner.

The data will be processed with automated tools and will be stored for a period of five years. The Data Controller shall take appropriate security measures in order to ensure a level of security commensurate with the risks of destruction or loss of data, of modification, unauthorised disclosure or of accidental or illegal access to personal data transmitted, stored or otherwise processed.

The optional, explicit and voluntary sending of documentation by e-mail to the addresses indicated in the Portal involves the simultaneous acquisition of the sender’s address, necessary to respond to requests for services and/or information, as well as any other personal data included in the message and/or attachments.

The Data Controller has appointed its own Data Protection Officer. Purposes and methods of processing

The personal data provided through the services of authentication of the digital identity provided by the Portal will be processed in compliance with the principles of lawfulness and correctness established by the Privacy Regulations, in order to allow users to demonstrate their identity in order to register with the Portal and access the services of a dispositive nature displayed on the Portal by the administrations who are responsible for the administrative procedure.

The data will be processed with automated tools. The Data Controller shall take appropriate security measures in order to ensure a level of security commensurate with the risks of destruction or loss of data, of modification, unauthorised disclosure or of accidental or illegal access to personal data transmitted, stored or otherwise processed.

Services of a dispositive nature, i.e. services that enable the entrepreneur or his/her delegate to compile and manage administrative obligations

Data Controller

The Data Controller is the Administration responsible for the administrative procedure initiated by the User. Unioncamere, headquartered in Piazza Sallustio, 21-00187 Roma, is the Data Controller with exclusive reference to the user’s navigation data collected in the business portalinungiorno.gov.it.

Purposes and methods of processing

All personal data provided through the Services of a dispositive nature made available by the Portal will be processed in compliance with the principles of lawfulness and correctness established by the Privacy Regulation, in order to provide Users with the services requested and to respond to any requests or communications of the Users, always in pursuit of the purposes of institutional type of the Owner.

The data will be processed with automated tools for the time strictly necessary to achieve the purposes for which they were collected or subsequently processed. Unioncamere shall take appropriate security measures to ensure a level of security commensurate with the risks of data destruction or loss, modification, unauthorised disclosure or accidental or illegal access to personal data transmitted, stored or otherwise processed.

Legal basis for processing

The legal basis for processing is reflected in the need for Unioncamere to perform a task in the public interest or related to the exercise of public authority pursuant to Article 6(e) of Regulation (EU) 2016/679. The Owner manages and makes available the Portal by virtue of the combined provisions of art. 4, paragraph 5 of the D.P.R. of 7 September 2010, n. 160 (where it states that “the municipalities may exercise the functions inherent to the SUAP in a single or associated form, or in agreement with the chambers of commerce”) and paragraph 11 of the same article (the latter for the reference to the agreement between Unioncamere and ANCI).

The data acquired for the purposes of the administrative proceedings of the Single Office for Productive Activities (after One-stop shop), displayed on the home page under the heading “Manage online the practices for your business”, are managed directly by the municipalities and/or other entities involved in the process of the procedures in force and are, finally, transmitted to the Chamber of Commerce competent for the collection in the Single Business Communication  referred to in art. 43-bis of Legislative Decree 445/2000 e.R.

Unioncamere disclaim any reponsability  for the administrative procedure of which the User requests activation and compliance with the relative terms of the procedure by the SUAP concerned. This, pursuant to Chapter II of Law 241/1990, remains the subject obliged to ensure compliance with the terms in question as with any other procedural performance.

Compliance with the rules relating to Chapter III of Law 241/1990 (participation in the administrative procedure) and, in particular, the availability of information on the state of the various phases of the procedure is directly ensured by the SUAP which is responsible for the ownership of the procedure, in accordance with the provisions contained in Chapter II of Law 241/1990, by means of the information provided directly by the SUAP itself and possibly made available by it through the Portal. Any deficiencies, inaccuracies, inaccuracies or discrepancies between the acts actually formed by the SUAP and what is made available to Users through the Portal must, therefore, be understood as determined by exclusive liability in every legal aspect of the aforementioned SUAP, with the exclusion of any related consequence, for any title or cause, to Unioncamere.

The optional, explicit and voluntary sending of documentation by e-mail to the addresses indicated in the Portal involves the simultaneous acquisition of the sender’s address, necessary to respond to requests for services and/or information, as well as any other personal data included in the message and/or attachments.

Services of the “Company and Central PA” section

The section of the Portal called “The Company and the Central PA” allows the sending of requests and requests to the individual Administration competent to receive them, as expressly indicated in each form of compilation and transmission.

Unioncamere disclaim  any responsability for the administrative procedure of which the User requests the activation and the respect of the relative terms of the procedure by the individual Public Administrations concerned. These, pursuant to Chapter II of Law 241/1990, remain the only parties obliged to ensure compliance with the terms in question as with any other procedural performance. In particular, the User acknowledges that the administrative procedure may be considered initiated only by the receipt of a specific notice pursuant to art. 7 of l. 241/1990 coming from the Administration to which the relevant ownership belongs.

Compliance with the rules relating to Chapter III of Law 241/1990 (participation in the administrative procedure) and, in particular, the availability of information on the state of the various phases of the procedure is directly ensured by the Public Administrations who are responsible for the same procedure, in accordance with the provisions contained in Chapter II of Law 241/1990, by means of the information provided directly by the same Administrations and possibly made available by them through the Portal. Any deficiencies, inaccuracies, inaccuracies or discrepancies between the acts actually formed by the Administrations and the participating bodies and what is made available to the Users through the Portal must therefore be understood as determined by the exclusive liability in every aspect of the aforementioned Administrations or Bodies, with the exclusion of any correlative consequence, for any title or cause, to Unioncamere.

Optional provision of data

The provision of data through the forms  on the Portal or the information transmitted on a voluntary basis by the same User, is always optional; However, in case of failure to provide data marked as “mandatory” within the application forms, Unioncamere and the public bodies involved in the administrative procedure, will not be placed in the conditions to satisfy the User’s requests.

 

Scope of dissemination of data

Any third party to whom the data may be communicated for the execution of processing operations related to the purposes specified in this policy, will be previously designated by the Data Controller as external data controllers pursuant to the Privacy Regulations. No data will be disclosed or disclosed in violation of the law.

Following access by the User to the functions made available in this Portal, the personal data are processed by Unioncamere, with registered office in Piazza Sallustio, 21-00187 Roma, which through InfoCamere S.C.p.A., the in-house company of the Chamber System, responsible for managing the technological infrastructure of the Portal and External Processing Manager, takes care of the technical organisation and the modalities of transmission of information to the other administrations that have in charge the provision of the services.

Use of cookies

Cookies are small text strings that the sites visited by the User send to his terminal (usually to the browser) where they are stored and then retransmitted to the same sites at the next visit of the same User.

The Portal may use “technical” cookies that do not allow the acquisition of personal identification data of the User, as best described below:

— session cookies – used to ensure the normal navigation and use of the Portal; Their use is strictly limited to the transmission of session identifiers (consisting of random numbers generated by the server) necessary to allow the safe and efficient exploration of the Portal; 

— functionality cookies – used to allow the User to navigate the Portal according to a series of selected criteria (such as the selected language) in order to improve the service rendered to it.

Data retention period

 

The personal data processed by Unioncamere will be promptly deleted when the purposes of the processing will be definitively exhausted. In the case of particular legal obligations, the processing of information will continue in accordance with existing legislation.

 

 

 

Rights of data subjects

 

Users may at any time exercise their rights of access to personal data provided for in the Privacy Regulation, in order to obtain confirmation of the existence of data concerning them, to access them, to rectify them, to delete them, to limit their processing or to oppose for legitimate reasons their processing, by sending a special request to the Data Controller, by e-mail or certified e-mail. Requests may be made: For data related to procedures of a provision nature to the competent municipalities and/or public bodies; For navigation data, the Digital Agenda Area and Unioncamere Business Register by writing to the e-mail address: Egov@unioncamere.it.
